1. General Provisions

(1) PEPA S.R.L.S. (hereinafter referred to as “PEPA S.R.L.S.”, the “Company” or the “Supplier”) sells products bearing the “Daniele Ancarani” brand in Italy and in countries where the online sales service is available.

(2) These General Terms and Conditions of Sale apply to all distance sales of Daniele Ancarani products made via the website shop.danieleancarani.com, including the assistance provided by Daniele Ancarani Customer Services. Distance sales are governed by current Italian legislation, the Consumer Code (Legislative Decree 206/2005) and European Directive 2011/83/EU on consumer rights.

(3) Use of the online sales service is restricted exclusively to consumers. The term ‘Consumer’ refers to any natural person who purchases products for purposes unrelated to their business, commercial, craft or professional activities. The resale, hire or any commercial use of products purchased on the website is prohibited.

(4) PEPA S.R.L.S. reserves the right to amend these General Terms and Conditions of Sale at any time. The terms and conditions in force at the time of purchase shall apply to the Customer; a copy of these will be sent to the email address provided when placing the order.

(5) These General Terms and Conditions of Sale are published on the website so that they may be consulted, stored and reproduced by the Customer.

(6) By placing an order on the shop.danieleancarani.com website, the Customer declares that they have read, understood and accepted these General Terms and Conditions of Sale in full.

(7) These General Terms and Conditions of Sale govern exclusively the sale of products marketed by PEPA S.R.L.S. via the official website. Any products or services offered by third parties via links on the website are governed exclusively by the terms and conditions of sale of the respective suppliers, for which PEPA S.R.L.S. accepts no liability.

(8) For all information relating to the processing of personal data, the Customer is invited to consult the Privacy Policy published on the website.

2. Product orders

(1) Orders may only be placed by persons of legal age and with full legal capacity.

(2) Orders may be placed directly via the website shop.danieleancarani.com or by contacting Daniele Ancarani Customer Services, Monday to Friday, during the hours indicated on the website.

(3) The Customer is required to provide a valid email address, through which they will receive all communications relating to the order, the purchase confirmation and these General Terms and Conditions of Sale.

(4) Each order may comprise one or more products, subject to any limits set by PEPA S.R.L.S. and published on the website.

(5) PEPA S.R.L.S. reserves the right to amend, at any time, the limits on the number of products that may be purchased or the types of items available for online sale.

(6) The Customer is responsible for selecting the products added to the shopping basket. Before the order is finalised, a summary will be displayed containing a description of the selected items, any sizes, colours and quantities, and the corresponding price.

(7) PEPA S.R.L.S. takes every reasonable precaution to ensure that photographs, images and descriptions accurately represent the products. However, slight differences in colour or appearance may be due to the settings of the device used by the Customer and do not constitute a product defect.

(8) Before completing the purchase, the Customer is asked to carefully check the contents of the shopping basket and to confirm their acceptance of these General Terms and Conditions of Sale.

(9) Should the Customer wish to amend or correct the order before final confirmation, they may follow the procedure set out on the website.

3. Product prices

(1) All prices published on the website are quoted in euros and include VAT as applicable under current legislation.

(2) Unless otherwise stated on the website or during the purchase process, prices include delivery charges, taxes and any customs duties applicable to the country of destination.

(3) The price charged will be the one displayed to the Customer at the time of order confirmation and set out in the relevant purchase confirmation sent by email.

4. Completion of the order

(1) The purchase process is deemed to be complete when the Customer definitively confirms the order. Following confirmation, the order is forwarded to PEPA S.R.L.S.

(2) Before definitively confirming the order, the Customer may amend or cancel the contents of the shopping basket at no cost.

(3) These General Terms and Conditions of Sale are always available on the website shop.danieleancarani.com.

(4) After clicking the order confirmation button, the Customer will receive an automatic email acknowledging receipt of the order. This communication constitutes solely confirmation of receipt of the order and does not yet represent acceptance of the order or the conclusion of the sales contract.

(5) The contract of sale shall be deemed to have been concluded only when PEPA S.R.L.S. sends the Customer confirmation of acceptance of the order to the email address provided during the purchase process. The confirmation shall contain a summary of the order, the price of the products purchased and a copy of these General Terms and Conditions of Sale.

(6) PEPA S.R.L.S. reserves the right not to accept orders if they are incomplete, incorrect, lack the necessary payment guarantees, or if the products ordered are unavailable. In such cases, the Customer will be informed by email within a maximum of 30 (thirty) days of receipt of the order. If payment has already been made, the full amount will be refunded.

(7) Once the contract has been concluded, the Customer will receive a written confirmation containing the order number, the date of purchase, a description of the products purchased, the price paid, the payment method used, information regarding the right of withdrawal, the returns procedure, the applicable warranties and the contact details for Daniele Ancarani Customer Service.

(4) In the case of payment by credit or debit card, the Customer declares that they are the legitimate holder of the card used. The payment provider may pre-authorise the amount due prior to the actual charge, without this constituting a final payment.

Should the order be cancelled prior to dispatch, any pre-authorised amount will be automatically released in accordance with the timeframes set by the Customer’s bank.

For items purchased on pre-order, the amount may be debited upon confirmation of the order in accordance with the terms specified during the purchase process.

(5) Should the payment be declined or unable to be authorised for any reason, the order will be automatically cancelled without any definitive charge being made to the Customer.

(2) All data entered on the PayPal website will be processed directly by PayPal and will not be disclosed to PEPA S.R.L.S., which will not have access to the credit card details or other payment methods associated with the Customer’s PayPal account.

(3) In the event of a refund, the amount will be credited back to the same PayPal account used for payment. The time taken for the credit to appear depends solely on PayPal and the Customer’s bank.

(4) Any disputes regarding the time taken for the credit to appear must be addressed directly to PayPal.

  • * Where the delivery address has a reception, concierge or other service authorised to receive parcels, delivery shall be deemed to have been validly effected upon receipt by such service. From that moment, the risk and liability relating to the products shall pass to the Customer.

    (6) Items will be dispatched only after confirmation of payment for the order.

    (7) PEPA S.R.L.S. undertakes to process orders within a maximum of 30 (thirty) days from order confirmation, except in cases of force majeure or product unavailability, of which the Customer will be promptly informed in accordance with Article 4 of these General Terms and Conditions of Sale.

    (10) Unless otherwise stated at checkout, delivery charges are included in the sale price.

    (11) Any additional delivery charges will be clearly indicated to the Customer before the order is confirmed. These charges will not be refunded in the event of a product exchange or the exercise of the right of withdrawal, except as provided for by current legislation.

(5) In the event of an order being cancelled prior to dispatch, no final charge will be made to the Customer. Should payment have already been made, PEPA S.R.L.S. will refund the amount paid using the same payment method used for the purchase, within the timeframes set by the relevant payment scheme.

For certain products, PEPA S.R.L.S. may offer the following services:

i. product customisation (“Customised Products”);

ii. advance purchase of products not yet available (“Pre-order Products”).

These special terms and conditions supplement the General Terms and Conditions of Sale and shall prevail exclusively in respect of the matters governed herein.

Article 1 – Orders and Payments

The following provisions apply to Customised Products and Pre-order Products:

a. During the product customisation process, the choices made by the Customer are stored solely for the duration of the browsing session. Should the session be interrupted before the order is confirmed, the customisation procedure will need to be repeated.

b. Following confirmation of the order by PEPA S.R.L.S., the Customer will receive an email containing the order confirmation and, subsequently, a notification regarding the dispatch of the product.

c. For Personalised Products and Pre-order Products, payment shall be made in accordance with the methods indicated during the purchase process and in these General Terms and Conditions of Sale.

Article 2 – Delivery of Personalised Products and Pre-orders

For Personalised Products and Pre-order Products, delivery times may be longer than for products that are immediately available.

Indicative delivery times will be stated on the product page and during the checkout process.

PEPA S.R.L.S. will notify the Customer by email as soon as the product has been dispatched.

If a single order contains products with different availability dates, PEPA S.R.L.S. may, at its discretion, arrange a single dispatch or separate dispatches, at no additional cost to the Customer.

Article 3 – Returns and Exchanges of Personalised Products

Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply to products made to measure or clearly personalised at the Customer’s request.

Consequently, except in the case of defective products or those that do not comply with current legislation, Personalised Products cannot be returned or exchanged.

However, all the Customer’s rights under the Statutory Guarantee of Conformity remain unaffected.
